Proskauer Sex Bias Case May Prompt More ‘Jane Doe’ Suits

Walsworth employment partner, Sage Knauft, was quoted by Law360, discussing the possible consequences of U.S. District Judge Ketanji Brown Jackson’s recent decision to grant a plaintiff’s request to proceed with her gender bias lawsuit under a pseudonym. Sage cautioned, “There is a certain threshold of merit [for claimants’ receiving anonymity]. If they don’t have to meet that threshold, the number of these type of cases might go up.”

A partner and practice group head from Proskauer Rose LLP’s Washington, D.C. office had launched a $50 million gender bias lawsuit against the firm and concurrently filed a request to proceed with the case under a pseudonym and to file personally identifying information under seal. This request was recently granted, bringing concerns from experts that this decision may spur an increase in bias for plaintiffs seeking to pursue their suits anonymously.
