Partners Laurie Sherwood and Mary Watson Fisher will hold a continuing legal education course titled “Big Brother is Watching: Do Employers Have the Right to Police Employee Off-Duty Conduct?” This presentation will address the issues on how far an employer may legally go to monitor and discipline employees for off-duty conduct. This seminar will touch on issues relating to enforcing alcohol and drug use policies, monitoring and disciplining off-duty social media posts, inquiring into or disciplining off-duty criminal activity, regulating workplaces romances and monitoring employees’ movements with GPS tracking. Attendees will learn about applicable California and federal laws and the best practices for navigating the delicate balance between employees’ off-duty conduct and the need to maintain a safe, productive and secure work environment.
